We are Metropolis Surveyors LLP with registered number OC307283 and registered address Crown House, 24-25 Turners Hill, Cheshunt, Herts, EN8 8NJ. Our Data Protection Lead can be contacted at compliance@metropolis-surveyors.com. We have produced this privacy notice in order to keep you informed of how we handle your personal data. All handling of your personal data is done in compliance with the General Data Protection Regulation (EU) 2016/679 ("Data Protection Legislation").

 This policy is effective from 1 April 2021.

What Information does the GDPR apply to?

  • Personal data

The GDPR applies to ‘personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier.

This definition provides for a wide range of personal identifiers to constitute personal data, including name, identification number, location data or online identifier, reflecting changes in technology and the way organisations collect information about people.

The GDPR applies to both automated personal data and to manual filing systems where personal data are accessible according to specific criteria. This could include chronologically ordered sets of manual records containing personal data.

Personal data that has been pseudonymised – eg key-coded – can fall within the scope of the GDPR depending on how difficult it is to attribute the pseudonym to a particular individual.

  • Sensitive personal data

    The GDPR refers to sensitive personal data as “special categories of personal data” (see Article 9).

The special categories specifically include genetic data, and biometric data where processed to uniquely identify an individual.

Personal data relating to criminal convictions and offences are not included, but similar extra safeguards apply to its processing 

What we collect

We may collect the following information:

  • name and job title
  • contact information including email address
  • demographic information such as postcode, preferences and interests
  • other information relevant to customer surveys and/or offers

What we do with the information we gather

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping.
  • We may use the information to improve our products and services.
  • For Legal reasons where we are required to do so.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information to customise the website according to your interests.

Data Subject Rights

Data Subjects Rights are as follows (these rights don’t apply in certain circumstances)

  • The right to be informed about our processing of your personal data;
  • The right to have your personal data corrected if it’s inaccurate and to have incomplete personal data completed;
  • The right to object to processing of personal data;
  • The right to restrict processing of your personal data;
  • The right to have your personal data erased (the “right to be forgotten”); see Appendix A
  • The right to request access to your personal data and information about how we process it;
  • The right to move, copy or transfer your personal data (“data portability”); and
  • Rights in relation to automated decision making including profiling.

 

 

Data Breaches

 

Where a potential breach has occurred this will be reported internally to the Data Manager at Metropolis Surveyors, as the main point of contact. This will include the full details of the incident, and by whom, in order that a full assessment can be made.

 

All data security breaches will be logged centrally into the Data Protection system of Metropolis, for retention and management and reporting purposes.

 

Under article 33 of the GDPR, Metropolis will notify the ICO if the breach is “likely to result in the risk to the freedoms and rights of natural persons”.

 

Such a breach will be communicated to the Data Subject (subject to certain exceptions), without undue delays and within 72 hours of being made aware of it.

 

The report to the ICO will contain information as to the nature of the breach, categories of data, number of data records, number of people affected, name and contact details of Metropolis, and the likely consequences of the breach and action taken.

Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

How we use cookies

Controlling your personal information

You may choose to restrict the collection or use of your personal information in the following ways:

  • whenever you are asked to fill in a form on the website, look for the box that you can click to indicate that you do not want the information to be used by anybody for direct marketing purposes
  • if you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us at info@metropolis-surveyors.com.

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. Metropolis Surveyors reserve the right to amend or modify this Privacy Policy at any time and any changes will be published on our website. The date of the most recent revision will appear on this web page. If we make significant changes to this policy, we may also notify you by other means such as sending an email. Where required by law we will obtain your consent to make these changes. If you do not agree with any changes, please do not continue to use our website and let us know that you wish to have your personal data deleted.

 

Appendix A

 

The “right to be forgotten”

 

Each customer shall have the right granted by the European legislator to secure from Metropolis Surveyors the erasure of personal data concerning him or her without undue delay where one of the following grounds applies, as long as the processing is not necessary:

 

  • The personal data is no longer necessary in relation to the purposes for which they were collected or otherwise processed.

 

  • The data subject withdraws consent to which the processing is based according to point (a) of Article 6(1) of the GDPR, or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing.

 

  • The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.

 

  • The personal data has been unlawfully processed.

 

  • The personal data must be erased for compliance with a legal obligation in the European Union or UK law to which the controller is subject.

 

  • The personal data has been collected in relation to the offer of information society services directly to a child, referred to in Article 8(1) of the GDPR.
